The following sections (7–14) apply specifically to Answer Engine Optimization (AEO), AI Visibility Architecture, and related digital services provided by TCC. These provisions are in addition to, and not in replacement of, the general terms above.
7. AI Search Engine Volatility and Algorithm Changes
AI search engines, including but not limited to ChatGPT (OpenAI), Perplexity AI, Google AI Overviews, Microsoft Copilot, Claude (Anthropic), and Gemini (Google), operate proprietary algorithms that are subject to change at any time and without prior notice. TCC has no affiliation with, control over, or advance knowledge of changes made by these platforms. Changes to AI search engine algorithms, ranking criteria, citation policies, or content presentation formats may materially affect the visibility and citation frequency of any business, including clients of TCC. TCC shall not be held liable for any reduction in AI search visibility, citation frequency, or organic traffic resulting from third-party AI platform changes, updates, or policy modifications.
8. No Guarantee of AI Citation or Ranking
TCC does not guarantee, warrant, or represent that any AEO strategy, implementation, or optimization service will result in specific placement, citation frequency, ranking position, or recommendation by any AI search engine. Results from AEO services vary significantly based on factors including, but not limited to: the client's industry and competitive landscape, existing content quality and authority, domain age and historical trust signals, the specific AI platforms being targeted, the nature and frequency of user queries, and the evolving standards of individual AI platforms. Any projections, estimates, or examples of results provided by TCC are illustrative only and do not constitute a guarantee of similar outcomes.
9. Content Accuracy and AI Hallucination Disclaimer
AI search engines may generate responses that contain inaccurate, incomplete, or fabricated information, a phenomenon commonly referred to as "AI hallucination." TCC cannot control, prevent, or be held responsible for inaccurate representations of a client's business, products, services, or information generated by AI search engines, even when structured data and AEO best practices have been implemented. Clients are responsible for monitoring AI-generated content that references their business and for reporting inaccuracies directly to the relevant AI platform. TCC may assist in developing correction strategies as part of an active service engagement but cannot guarantee the removal or correction of AI-generated misinformation.
10. Third-Party AI Platform Dependency
AEO services are inherently dependent on the continued operation, accessibility, and policies of third-party AI platforms. ChatGPT, Perplexity, Google AI Overviews, Microsoft Copilot, Claude, Gemini, and similar platforms are independent commercial entities not affiliated with TCC. These platforms may restrict, limit, or discontinue their services at any time. TCC's AEO strategies are designed to optimize for current best practices across these platforms; however, TCC cannot guarantee continued access to, or favorable treatment by, any specific AI platform. Service agreements with TCC are not contingent on the continued availability of any specific third-party AI platform.
11. AI Visibility Score — Data Usage and Privacy
The AI Visibility Score audit tool ("Audit Tool") is provided as a complimentary assessment to help businesses understand their current AI search visibility posture. By submitting your website URL and contact information through the Audit Tool, you consent to the following: (a) TCC may analyze publicly accessible information associated with the submitted URL for the purpose of generating an AI visibility assessment; (b) your contact information will be used to deliver the assessment results and may be used for follow-up communications related to TCC's AEO services; (c) aggregate, anonymized data from Audit Tool submissions may be used by TCC for research, product development, and marketing purposes; (d) TCC will not sell or transfer your personal information to third parties for their independent marketing purposes. You may opt out of follow-up communications at any time by contacting TCC at [email protected].
12. Client Responsibility for Content Accuracy
Clients engaging TCC for AEO services are solely responsible for the accuracy, legality, and appropriateness of all content provided to TCC for optimization, including but not limited to website copy, product descriptions, service information, credentials, testimonials, and claims. TCC will implement structured data, schema markup, and optimization strategies based on the information provided by the client. TCC assumes no responsibility for inaccurate, misleading, or legally non-compliant content provided by the client. Clients warrant that all content submitted for AEO optimization is accurate, does not infringe on third-party rights, and complies with all applicable laws and regulations.
13. Intellectual Property of AEO Strategies and Deliverables
All AEO strategies, frameworks, methodologies, and deliverables developed by TCC, including AI Visibility Blueprints, schema markup implementations, content architecture plans, and authority-building protocols, are the proprietary intellectual property of Total Control Consulting, LLC. Upon full payment of applicable fees, clients receive a limited, non-exclusive, non-transferable license to use the specific deliverables created for their engagement. Clients may not resell, sublicense, or represent TCC's proprietary methodologies as their own. TCC retains the right to use anonymized case studies, performance data, and general learnings from client engagements for internal research, product development, and marketing purposes, subject to client confidentiality obligations in the applicable service agreement.
14. Limitation of Liability for AEO Recommendations
TCC's AEO recommendations are based on current industry best practices, publicly available information about AI search engine behavior, and TCC's proprietary research and experience. These recommendations are provided in good faith but do not constitute a guarantee of specific outcomes. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TCC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE IMPLEMENTATION OF AEO RECOMMENDATIONS, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITY, REDUCTION IN SEARCH VISIBILITY, OR NEGATIVE IMPACTS FROM AI PLATFORM ALGORITHM CHANGES. TCC's total liability for any claim arising from AEO services shall not exceed the total fees paid by the client to TCC in the three (3) months preceding the claim.

IN NO EVENT SHALL TCC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO TCC DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
17. Indemnification
You agree to defend, indemnify, and hold harmless Total Control Consulting, LLC, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the Site caused damage to a third party.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. TCC reserves the right to suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

TCC reserves the right to modify, update, or revise these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes.
21. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
